The duties of the Treasury Solicitor were first recorded in a commission of 1661, when the position was called the Solicitor to the Exchequer. After 1842, duties included acting as solicitor to further government departments, and providing legal services, including the drafting of legislation and contracts. In 1876, the Treasury Solicitor's department took responsibility for intestate estates.
