A File of proceedings (certified copies) before the Council of the Marches of Wales in a suit between Walter Powell, complainant, and William Powell, defendant, consisting of:. 1. Bill of Complaint of Walter Powell of Llanyssen, gent. his father David Philipp Powell, gent., deceased, was seised in fee according to the custom of the lordship or manor of Caldicott of a customary messuage and tenement and divers customary lands in the parish of Lanvihangell tormenyth and so seised died about 30 years ago, by whose decease the premises (of yearly value of £20) descended by the custom of the manor (being in the nature of Borough English) to complainant as youngest son, being he an infant of the age of three years. William Powell of Lanpillth, esq., immeadiately after the death of his father and during complainant's minority entered and for 18 years received the rents and profits to his own use (as complainant's tutor and guardian) so receiving £340, complainant entered when he was 21 years of age and enjoyed the premises until defendant by colour of having gotten into his custody diverse ancient deeds and court roll mentioning the custom aforesaid entered and detained, by which he is in arrears to complainant since he was 21 in the sum of 300 marks, making a total since his father's death of £493. 2. Answer of defendant to bill of complaint. The lands alleged to be customary are freehold or charter hold held in socage of the manor and lordship of Caldicott, which descended of right to defendant as son and heir. 3. Replication of complainant. 4. Process at Ludlowe, 26 October 1604. Order for examination of witnesses.
